Power Structure
The State Attorney General's office and the District Attorney's office in any county in America is readily available for the FBI's service and projects. The FBI's facilities and vast resources are also readily available through its local division offices to any District Attorney's office and State Attorney General in America.
The FBI is charged with investigating Color of Law crimes/violations. Despite numerous cases and complaints of abuse of power, hardly any District Attorney has ever been prosecuted for such violations. The power structure is one and the same, having common goals and objectives and covering up for each other's misdeeds. (see- Abuse of power)


The Case
The Michael Jackson case is unprecedented in America whereby the county's District Attorney personally seeks to prosecute him, the police investigation is personally conducted by the county's Chief of Police/Sheriff and the county's Presiding judge bypasses normal means of picking a judge at random and handpicks his deputy who is to be the next presiding judge, to see the case through to trial even before charges are filed, with the case judge declaring the case will go to trial even prior to a preliminary hearing where the defense would be able to cross examine the accusers and present exculpatory evidence. (A convergence and manipulation of the 3 arms of government due to a law passed after 1993, specifically intended to target Michael, by requiring no evidence to convict, only that a jury chooses to believe either the accuser or the accused - capitalising on prejudices directed at Michael).
The prosecution of Michael Jackson, the most prominent African American in the world, who resides in Santa Barbara county, overlooks a social services investigation report concluding that the allegations are unfounded, overlooks the timeline in which the allegations are made, overlooks surveillance systems showing that no crime was ever committed, overlooks attorneys and numerous witnesses from all walks of life that were present and moreso overlooks the fact that Michael Jackson was not with the accusing family most of the dates used in the timeline and is never alone with anyone after the 1993 plot. The prosecutors' aim is to convince a predominantly conservative jury to share the same underlying prejudices and to believe the prosecution's own interpretation of Michael's life as has been depicted by a hostile media over the years, regardless of the facts, or what he or those who know him may say.

Most important of all, the prosecution promotes innuendo and insinuations that have lasted for over 2 decades, meant to defame Michael Jackson through the media and overlooks documented information that the mother of the child plotted to frame Michael Jackson before she and her family ever met him. Instead, a variety of means are used to circumvent and ignore this information while issuing excessive search warrants that violate Michael Jackson's constitutional and civil rights. This includes obtaining information that has no relevance even to the fabricated allegations/case.

JERMAINE JACKSON: And it also has a lot of -- it has a lot of consequences and responsibilities, too. And still, when you look at just his level of consciousness and where he is, and his ability, I think it's done purposely to sort of just get him away from the masses, the people. And when you sort of come in between that, you betray someone as this character that's crazy. Just with all the things. Even those crazy allegations about child molestation. And then having the district attorney during the time to come to our house and break open medicine cabinets and safes and this and that. What were they looking for? And at the same time while all this is going on, I produced a show called the Jackson family honors. Michael comes out while all this is going and gets a 20-minute standing ovation to see the love and reception from the people. During the time -- our district attorney is watching this. He rose at the TV and said, we'll never get him. What it is, Michael's a powerful in his art, and that creates problems in other areas. And I do believe that there are attempts in people to try to discredit that. I mean even with...

The Evidence

1993
Filing allegations - 17th August 1993
The mother of the child (June Schwartz) files an ExParte motion in court on the 16th August 1993 through her lawyers for the child to be returned to her.

On the 17th August 1993, the Court orders Evan Chandler to return the child immediately to his mother.

Evan Chandler circumvents the order by taking his son to his dental surgery and along with a colleague, subjects the child to Sodium Amytal.

2003
Filing allegations 12th June 2003
The mother of the child (Jane "Doe") proceeds with her children to the same 1993 lawyer who reached a civil settlement with Michael Jackson, after taking over from Barry Rothman, Evan Chandler's original lawyer.

The lawyer, Larry Feldman proceeded to refer the family to a psychiatrist he used with the 1993 kid leading up to the civil settlement.

1993
The psychiatrist - 17th August 1993
Evan Chandler then takes the child to a preplanned psychiatrist where the child makes the allegations.

The psychiatrist proceeds and files the charges with the social services who forward the case to the police.

Chandler later states the allegations first came out while the child was in his dental chair.

2003
The psychiatrist - 12th June 2003
The psychiatrist led on the child into making allegations with promises that the family would get money.

The psychiatrist then reports the details back to Larry Feldman. Both of them proceed to the social services to file the case. They are informed an investigation was carried out during the same alleged period.

Larry Feldman asks the social services not to leak the results of the investigation, allegedly as happened in 1993. He proceeds to contact Tom Sneddon and file the allegations.

Search warrants - 21st August 1993

The search warrants are served and executed on the 21st August 1993 on:

* Neverland Ranch
* Michael Jackson's apartment in Los Angeles
* The Jacksons family home in Encino

Diane Diamond, a Hardcopy journalist, leaks the details of the allegations on TV.

2003
13th June 2003: The investigation is re-opened, no search warrant is sought (18 days go by)

July 2003: No search warrant sought (31 days go by)

August 2003: No search warrant sought (31 days go by)

September 2003: No search warrant sought (30 days go by)

October 2003: No search warrant sought (30 days go by)

November 2003: No search warrant sought (17 days go by)

The only other factor that might have delayed the search warrants is a review of the social services report that contradicted the allegations made, which at most would take a month (and which was reviewed by the judge signing off the warrants in just a few hours).

Also unlike 1993, the change in law only required an allegation to commence the case, and for the jury to believe the accuser, no evidence.

In early November 2003, the mother meets with Tom Sneddon in an empty car park at the back of a federal building. With no one else present, she hands Tom Sneddon a jacket and CD belonging to her son, which he puts in the trunk of his car. Tom Sneddon then hands the mother of the child victim compensation forms so as to claim money.

Tom Sneddon had personally gone out to check the offices of Brad Miller, a private investigator employed by Mark Geragos, Michael's then attorney.

* The home of Hamid Moslehi, Michael's videographer
* Bard Miller, Private Investigator

* This time alleged 'pornography' is found to corroborate the accuser's allegations.
* Open bottles of alcohol are found to corroborate the accusers' alcohol allegations. (Michael has been in Las Vegas since October, wine goes bad in 3 days and Michael has maids that clean up daily).
* A card addressed to the accuser is found as well as a photo signed out to him to corroborate the allegations.

Description - photos
The description Jordy Chandler gave to the police about Michael Jackson's body parts did not match the photographs taken. Despite having photographed at close range every inch of Michael Jackson's body, the prosecutors wanted to photograph him again due to the failure in the match up. His lawyers declined.

Reuters reported on the 27th January 1994 that the photographs did not match the accuser's description. Little coverage was provided for this information.

Breaking news of the search
Diane Dimond, the same person who broke news of the 1993 allegations, also breaks the news of the search and arrest warrants as well as details of the allegations made.

She proceeds to state that the information was only known to a few select people in the Santa Barbara law enforcement.

Settlement
Michael Jackson was compelled to settle the civil case due to a number of factors

* A civil trial would jeorpadise his right to a fair criminal trial due to the media's hostility toward him, the innuendo that would carry on in the public for months causing jury poisoning for a criminal trial and attempts by prosecutors to use the civil trial as a platform to base on a criminal trial
* The racism that was prevailing through the police and prosecution, especially after the Rodney King incident.
* Politics that had become entangled in the case, Santa Barbara DA Tom Sneddon's upcoming re-election and the discovery of information that he is a racist, following a rebuke directed at his office by the California Supreme Court in 1993 for racist conduct in court in another case.

Targeting Michael Jackson's marriages to ruin his life

The targeting of Lisa Marie and Debbie Rowe by sections of the media and prosecution has been an attempt to utilize the old concept that has existed within the judicial system of pitching one race against another.

To Kill A Mocking Bird

* As illustrated in the film "To Kill a Mocking Bird", it is the effort throughout American history, by extremist and prejudiced prosecutors, sheriffs and people in society, to challenge a jury whether they will uphold the testimony of a white woman over that of a black man
* Therefore, attempts have been made by several individuals, including Tom Sneddon, the Santa Barbara DA, who reportedly approached Lisa Marie's mum twice in 1995 in an effort to get her daughter to accuse Michael of child abuse.

Meanwhile, Saturday's Today newspaper said Santa Barbara, Calif., District Attorney Tom Sneddon had twice contacted Presley's mother, Priscilla, for information about Jackson's relationships with young boys.

* Sections of the media, prosecution and critics of Michael Jackson would then seek to convince the public and in turn a jury, that if his wife has stated so, then indeed Michael is guilty, since the 288a law that Tom Sneddon and Gil Garcetti advocated for after 1993 due to the failure to find any evidence of wrongdoing, does not require the alleged victim to be present or evidence to be provided. It only requires that simply an accusation be made and that the jury decide whether or not to believe the accusation.
* The other strategy, as was reported by some tabloids and even the mainstream media after the divorce, would also have been to get Lisa, (as in the McMartin case in 1984), to use any of her kids to accuse Michael, simulating what Evan Chandler had done.

Diane Sawyer: You said you had seen him with kids, how they throw themselves on him..

Lisa Marie Presley: Yeah but you see that's not to be you know, I saw that with babies, like even little infants. He had a connection with children, it doesn't necessarily mean just 12 year old boys or something, you know what Imean, I saw it with little girls, I saw it with, I just saw that he had a connection, he had something with children, not a bad, perveted weird thing, I didn't pick it up as that, they responded to him, he responded to them.

* While many in the public saw the Michael Jackson and Lisa Marie marriage as a dream marriage of two legendary musical families, extremists could not stomach the idea that Lisa Marie, who is considered royalty in American society as the daughter of the King of Rock - Elvis Presley, was getting married to an African American, a descendant of former slaves.
* Given the diverging views and ideologies in society, it was perceived as a "nigger" marrying the princess.
* Michael Jackson was also not simply marrying any caucasian, which ultra-conservatives had atleast learned to tolerate over the years (see history of interracial relationships) with other African Americans and Michael's relationship with Brooke Shields, he was marrying into what was considered American royalty.
* While Michael Jackson had known Lisa Marie from childhood, fancied her and in the mid-80's was quoted as saying "my dream is to marry a princess and live happily for a lifetime", others sought to view the marriage differently.

Lisa Marie Presley: That's what my mum was trying to point out like "Hello, are you awake? Can you see this might be coordinating or coinciding with something else?" And I didn't see that, like, I was young. I don't know. I mean, it looked a little suspicious but at the same time I know that he loved me, you know, as much as he can love someone, I think he did.

1994 - Reports of racial slurs by some senior government officials in Santa Barbara with regard to the marriage between Michael Jackson and Lisa Marie

Given their ultra-conservative views and America's history, there is less tolerance for racial mixing and moreso interracial marriages in what is predominantly a white conservative county.

There are reports that during a fundraiser party for Tom Sneddon, racial slurs were directed at Michael Jackson also questioning why he was married to a white woman. Tom Sneddon is alleged to have stated that steps were being undertaken to run him out of the county (intolerance of a prominent and wealthy African American in the county).

1995 -Interview, Lisa Marie and Michael Jackson
are questioned by Diane Sawyer among other things, about their marriage and the 1993 allegations

* The media and detractors who were trying to use the allegations to ruin Michael Jackson were put on a backfoot by the marriage. Suddenly, it was impossible for them to portray Michael as a gay child molester.
* The attacks then turned on attacking their marriage with a variety of insinuations, and the formulation of various theories, such as stating that it was simply a "marriage of convenience", Lisa Marie was after Michael's money and several other concocted stories.
* During the interview, Lisa Marie made a point about the ever increasing degrading comments about them in the media.(covert racism)

1995 Interview with Diane Sawyer
Lisa: (laughs) I just want people to know what they're dealing with, before...and understand that I'm not - that we're not - the jokes, the degrading comments, all that kind of stuff. It's really irritating. So, I didn't get to get in there...this is over already, but...um...

Michael: We want to choke them!

Diane: Alright, so five years you want to...

Lisa: Yeah. We want to choke them.

Michael: Don't believe the garbage, all the tabloid junk. Don't read it. Don't listen to it. It's junk. It's stupid.

1995: The attacks by the media simply kept on escalating. This put added strains on Michael and Lisa's marriage given the fact that he had a busy schedule and was rarely with her.

Reports began to surface that the marriage was failing and in response, Michael's manager sought to counter this by getting Michael and Lisa to make a public kiss at the MTV Awards show. Lisa Marie got upset about what she refered to as the "stunt" by Michael's manager.

Matters were made worse when Michael collapsed during rehearsals and was admitted into hospital. An argument between the two over Michael's schedules resulted in Michael telling Lisa he wasn't feeling well and that she should go home. Lisa in turn later recalls stating in reply "fine, I'm out of here" and later contacted her lawyers to file for divorce.


1996 - Michael Jackson married Debbie Rowe whom he had known for over a decade.

* Attacks resumed, claiming that Michael Jackson does not marry black women.
* Attacks were also directed at Debbie Rowe and her upbringing. Efforts were also made to dig up anything negative in her past, but these yielded nothing.
* When Debbie Rowe gave birth to their first child, the attacks turned cruel and vile, questioning why she would bare a child for someone who was accused of child molestation. The detractors through the media deliberately overlooked the evidence exposing the extortion plot and further evidence that exonerated Michael Jackson. Instead, they sought to use teh civil settlement as evidence of guilt irrespective of the facts.



Michael and Debbie divorce
1999 - On the 8th October 1999, Michael Jackson and Debbie divorced

* Media attacks had escalated to unbearable proportions for her.
* The media was also making statements attacking her as a mother and also untrue stories that Prince was about to die.
* Death threats were being sent to the baby Paris, among other vile actions.
* As in the Martin Luther King scenario (details) where similar attempts were made to break up his marriage, there was the belief that by Debbie divorcing Michael Jackson, it would reduce his stature in society as a divorced man.

Debbie remarks regarding expecting Prince:
"Michael told me 'you don't know what they can do to you', I said, what is wrong with having a baby, everyone has babies, why was I wrong?!, at one point there was a photo of me pregnant going for half a million!"

Debbie about the divorce:
"It reached a point I couldn't take it any more, I couldn't go out shopping, there were stories on the newstands that were not true, Michael said 'you don't have to go out', but I said 'I want to, I want to go back to what I was used to.'

Tom Mesereau (2004):
Those who wanted to profit from his good deeds and vulnerabilities were also threatening to destroy his ability to raise his own children and to champion the welfare, integrity, humanity and interests of children around the world. Michael Jackson occupies a world where his privacy is continually violated.

2003 - Lisa Marie begins promoting her first ever album.
During interviews, the media mainly focused around her relationship with Michael Jackson and the 1993 allegations that had already been answered.

Though she had already lent support to Michael Jackson, after the airing of the Martin Bashir negative documentary, the media used her to further slander Michael Jackson by constantly asking and placing leading questions that insinuated impropriety.

2003 Interview with Diane Sawyer
Lisa Marie Presley: I was already friends with him, there was already some romantic stuff going on a little bit before that happened. So it was like, I was already like, you know, I was the only one he would be calling so I felt all privileged and, you know, that he was trusting me and telling me what happened and it was very convincing and I believed him, at the time.

Lisa Marie spoke about having drank alcohol with Michael.

Later in June 2003 after her remarks, the current accusing family claimed that Michael Jackson gave all of them alcohol.

These allegations later made their way into the current case led by Tom Sneddon focussing instead solely on the male child depicted and exploited in the Martin Bashir documentary. The child and his siblings had been coached to claim Michael Jackson gave them alcohol every night so as to abuse them.

Unfortunately for the family and the people aiding them, they had forgotten or deliberately overlooked the fact that Michael Jackson had lost trust of many adults around him and that his home was covered with surveillance systems.

I knew Slimedon was after Michael's property to turn into a vineyard but I didn't know the extent of his involvement with the wine merchants and corporations. Your chart shows the definite link. So, there is definitely a tie to Melville? I have been suspecting this for a long time but didn't have the proof until now, thank you. Melville's actions in this case, have spoken louder than his words.

I've just read the other stuff you posted as well Illigitt - I cannot believe that people would behave like this in our day and age. I come from South Africa, where Apartheid was law. The Apartheid Regime did many horrific things covertly. Black people had to carry around a passbook (identity document), had to be in their houses at certain times or they were locked up. Looks like Apartheid is still rife in Santa Barbara, to this very day - and they don't even make excuses for it. Are the Santa Barbara people that fast asleep, or is Slimedon Madhog in such a high position of authority that people are petrified of him and he cannot be touched, even by the law, no matter how much he abuses the legal system? He doesn't even try to do these things covertly - he does it quite openly and it is acceptable, with no one doing anything to stop him? Look how he has been abusing the legal system for the decades and going after Michael too, who is just one of many. And Santa Barbara Governing bodies are settling court cases involving him, quietly. Being sued and paying out huge sums of tax-payers hard earned dollars (which range in the millions), and then putting a Clauses into it, thereby gaging people not to discuss the atrocities of this man. Typical recent example - Dunlap vs Sneddon, which is still ongoing for the sum of $10m. Is Mr Dunlap the only person to stand his ground and not be intimidated by this man. Mr Dunlap, will not settle out of court, thereby guaranteeing his silence - but taking his case to court and having this man exposed for what he is.

Has the colour of a man's skin become that important to these people, that are so blinded by their hate, that they cannot look into a man's heart anymore, but rather at his skin? It is a total disgrace and something should be done about it!

There is a lot at stake and there is a lot of things that are reported, because of who he is, that are not reported accurately. Things that are being said, and the thing that is most important that people wait for the facts instead of addressing things using their own opinions about things.

Pat: What's been inaccurate?

Jermaine: It bothers me when people call my brother a pedophile. There has been Rosie O'Donnell and people like that who have called him a pedophile when my brother was never charged or never indicted on anything.

Pat: But he did settle it?

Jermaine: No, what that was - and I feel that I can speak out on it - when someone really did something like that, would money solve the problem? No. I think I know this was motivated by money. There have been people who have been working on my brother who had said, 'If you ever get rid of me I'll make sure you never sell another record in your life.'

Jermaine discusses the Sony vs Michael Jackson feud

Pat: Let's talk about this album, because that's the centerpiece of this whole thing. Sony says that they put in [US]$25-30 million.

Jermaine: That's what they say.

Pat: They say they've put in $25 million of promotional money. $30 million to make it and the album is basically a bomb. Do you think it's a good album?

Jermaine: I think it's a great album. You know why? Because it was at a time when Michael knew he had to deliver, and he's not just going to put out anything. He was recording for a while and he turned it in.

Pat: Where was Michael in promoting hits? They say he didn't go to promotional appearances. He went to one black radio station.

Jermaine: I'll tell you this: We played in New York. You were there, and I know for a fact that Sony did not buy one ad for our show and it was right in their backyard. I don't know the facts, but it could have been that he was upset - I have a feeling. I just know that record companies aren't going to send you on a great launching to go somewhere else that's impossible...I'm not saying that things haven't happened. But until we get the facts we don't know. Let's open the books and let's see.

Marc Schaffel's role in charity single

Pat: This Marc Schaffel [producer behind Michael's September 11th charity recording, "What More Can I Give?"] thing. This producer has ties to the whole gay-porn industry. What happened?

Jermaine: I really don't know, but I read about that. I will say that there are a lot of actors or actresses in this industry that started out in porn. There are a lot of directors and producers in this industry that also started out in porn. Whether Michael knew or not I don't know. I would say that he didn't know, but to make that a big issue, so what? That's not what Michael's representative of.

Report regarding Mottola injecting Schaffel into feud between Sony and Michael Jackson

But as this column pointed out on Friday, much as it might be unseemly, adult video directors and producers work in mainstream pop video production all the time. Britney Spears, Mandy Moore and others have used Gregory Dark, an infamous porno director, to make their videos. Dark, who has directed videos for LFO, Ice Cube and the Counting Crows, according to Entertainment Weekly, told that magazine's Web site on February 4, 2000, that ''I don't deny that I did it, it's just that I also like people to know that I don't currently and haven't in a long time.'' EWonline surmised increased publicity wouldn't hurt his career: "I don't think people who buy records are too concerned about the background of the video's director.''

Billboard reporter Carla Hay was quoted in the story. And Steven Gottlieb of the music video trade the CVC Report told them Dark's rockers and hip-hoppers might be turned on by the notion of working with a porn director: ''A lot of those guys would be sort of excited by that.''

So what to make of all this? It's just another volley from Sony and Mottola's camp in a smear campaign against Jackson. Last year, Mariah Carey was "crazy." This year, Jackson cavorts with porno people. What will happen this week?

Expect more stories about Jackson as a pedophile, more of the racism talk, and an old canard is about to surface: that Jackson is an anti-Semite because of lyrics he used on the History album. Of course, when these stories come up, it will be conveniently forgotten that Sony backed Jackson 100 percent at the time.

Correspondence between Michael and Tommy Mottola

The Michael Jackson-Tommy Mottola standoff is heading into new territory. A serious source close to Jackson told me yesterday: "There is correspondence between Michael and Tommy that will show why Michael has done what he's done. When it comes out it will clear the whole thing up. It's all about Tommy goading Michael to respond the way that he has."

My source says that on more than one occasion he has been present during speaker calls between Jackson and Sony Music President Tommy Mottola in which Mottola "threatened" Jackson. "Not physical threats, but certainly the threat that Michael would be destroyed and his career would be over if he didn't agree to Tommy's terms. It's Tommy saying 'I'll ruin you.'"

The basis for all this? "The Beatles catalog," says my source. "That's it in a nutshell. This has all been done by Tommy in an effort to squeeze Michael financially. Tommy wants the Beatles catalog."

Stepping up spin war against Michael Jackson

Don't believe the stories you're hearing this weekend about why Michael Jackson's charity single isn't coming out. Sony Music's new excuse is that the single was shelved because it was suddenly discovered that the executive director of the project had a porno past.

But record and video producer Mark Schaffel – whom this column has interviewed off and on since last October (see Fox 411 archives) – tells me that his ties to adult videos were severed prior to working on this project. In any case, porno video directors often work with pop stars. Case in point: I can tell you that squeaky clean teen idol and heartthrob Britney Spears has often worked with infamous porno director Gregory Dark. So have Mandy Moore and other teen pop stars.

Most importantly, Sony's Tommy Mottola has stepped up the spin war with Jackson in the last 24 hours, emphasizing the latter's so-called sexual weirdness and the racism issue. But what's really going on here is a wholesale attack on Jackson to destroy him once and for all. It's a scorch-the-earth scenario in which the victim and all his associates are ruined.

For example: Schaffel, sources say, was told last fall that Mottola and Jackson's manager Trudy Green hired a private eye to dig up dirt on him when they were afraid that Jackson was listening to Schaffel's advice about his career. Jackson has all but dismissed Green and HK Management as his official managers. "He didn't think they were doing enough to push the new album, Invincible," Schaffel says. "And they were mad at me."

According to sources, Schaffel's friends were contacted by the private eye: "The only thing they were able to dig up was the porno stuff and now they're using it."

Blocking charity single, threatening Michael, MacDonalds drops promotion

Forget about porno or any other spin coming out of Sony this weekend. What's clear now is that Sony never wanted "What More Can I Give" to be released. The corporation didn't care about the money it might raise for the Sept. 11 victims. (Instead they released "The Concert for New York" and an album of standards by all their artists except Jackson.)

Schaffel, in an interview with this columnist, says that last fall when "What More Can I Give" was being planned, Sony execs Michelle Anthony and Polly Anthony (no relation to each other) called him and in a heated conversation accused him of advising Jackson in tactics to push the single.

"They didn't want 'What More Can I Give' competing with Invincible. They didn't want them to buy the charity single and then find it wasn't on Invincible."

The cancelling of "What More Can I Give" had nothing to do with McDonald's disapproving of Jackson, Schaffel says. "They didn't consider it a Michael Jackson record," he says. "They thought of it as an all-star tribute." Ultimately McDonald's had to back out, he says, because Jackson missed the delivery date and the fast food company was preparing for its holiday promotions.
